One of the biggest concerns that parents have is how to provide for a special needs child when both parents have died.  Parents of a special needs child often know that the child will never be able to manage assets on his or her own behalf, and further that if the child is eligible for very valuable public benefits, receiving monies outright or in the wrong kind of a trust can render the child ineligible for services and may require an expensive court-supervised financial guardianship.

We have experience in customizing Special Needs Trusts that will enable the special needs child to continue to qualify for benefits, while at the same time allowing for distributions to be made to improve the quality of the child’s life and care.  When preparing estate planning documents, don’t forget to talk to your estate planner about your wishes for a special needs child, or other family member, regardless of age.
